[1] Kreishan v. Canada (M.C.I.), 2018 FC 481.

[2] The actual name is Agreement between the Government of Canada and the Government of the United States of America for Cooperation in the Examination of Refugee Status Claims from Nationals of Third Countries. This agreement came into effect on 29 December 2004. 

[3] To be able to enter Canada through an exception to the STCA, the refugee claimant must have a family member who is a Canadian citizen, permanent resident, protected person, subject of a stayed removal order, has an ongoing refugee claim or certain type of work permit or study permit. Refugee claimants may also qualify for an STCA exemption if they:

  • are under the
    age of 18, unaccompanied by a guardian and not have a guardian in Canada or the
    USA;
  • have a temporary
    resident visa, permanent resident visa or a permanent resident travel document
    from Canada; or
  • are legally
    authorized to enter Canada without a visa but require a visa to enter the USA.
    See s. 159.5 of the Regulations for details.

[4] The Federal Court may consider the correctness of a decision if there are issues concerning the fairness of the RPD hearing. For other issues, the Federal Court considers the reasonableness of the RPD’s decision.
