My Wife Can be Deported?
As I prepare late into a Sunday evening for another immigration deportation proceeding at the Federal Court (early Monday morning) I thought about how this looks from my client’s perspective.
What’s at stake?
My client is facing deportation and the possibility of being separated from a Canadian spouse and step son. Yes even though you are married your spouse can still be deported depending upon where in the process you find yourself. No criminality here, no medical concerns – just an application that has not been decided for eight months by Immigration Canada.
This is one area we continue to lobby the Government to change. The Government should not be pre-determining deportations before a marriage application has been decided. My client is a few months away from having a decision on the spousal sponsorship.
The Canada Border Services Agency decided it could not wait.
So we are off to court. Must look kind of strange from the outside.
Well, back to work.
